Hungary Referred to EU Court for Breaching Rules on Human Smuggling

The commission's statement on Wednesday cited Hungary as "failing to fulfil its obligations ... to impose effective, proportionate" sanctions for the offence of migrant smuggling under EU rules setting criminal penalties for such misdeeds.
It noted that a government decree adopted in April 2023 allows persons convicted of migrant smuggling to be released from prison after a short time and deported from Hungary within 72 hours to serve "reintegration detention" in the country of their former habitual residence or of nationality.
The statement added that this decree undermined the goal of effectively tackling migrant smuggling and joint EU efforts to counter migrant smuggling.
