LGBTQ+ Law Reform in Hungary Faces Calls for More Changes

The government's recent proposal to scrap "unlawful stipulations in the 2021 homophobic and transphobic propaganda law" is an important measure, civil rights groups said on Tuesday, adding however that the proposal was "deficient on several points".

In a statement, Amnesty International Hungary, Hatter, the Hungarian Helsinki Committee, and the Association for Freedom Rights offered help to draft changes to address omissions from the bill submitted on Monday.

Among the proposals, they suggested scrapping the possibility of banning future Pride marches through changes to the constitution. This possibility, they insisted, served as the basis "for the propaganda law and consequent bans restricting the assembly of sexual minorities".

The Fidesz-era "propaganda law" passed in 2021 banned the "promotion" of homosexuality or gender reassignment to minors, casting it as a measure to protect children. Critics, including the EU and human rights groups, condemned it as a discriminatory, anti-LGBTQ law that stigmatised sexual minorities and restricted free speech. The law was widely criticised for its vague wording and chilling effect on education, media, and public discourse.

The rights NGOs also said that the new Tisza government proposal would not affect "passages in the constitution stigmatising LGBT people" and that it did not seek to remove all stipulations of the "propaganda law".

"Further changes will be needed to leave behind one of the meanest political products of the Orban era and complete the stipulations of a relevant European court ruling," the civil groups said.
