Court Reinstates Judge Forced Into Retirement In Hungary
The Zalaegerszeg Labour Court on Thursday struck down as unlawful the forced early retirement of a judge by the president of Hungary and the Kaposvár Court. The court reinstated the judge, aged 62, in her position in Kaposvár, after she was dismissed in July because of her age. Her dismissal was to take effect October 1.

The National Judicial Office has not yet decided whether to appeal, and has 15 days in which to do so.

The Zalaegerszeg court noted that the Constitutional Court had struck down with retroactive effect the law that compelled judges over 62 years of age to retire.

Separately, the Kaposvár Court passed a similar ruling for a judge who will be 62 years old this year, striking down his forced early retirement.

The Judicial Office says about 150 judges have filed labour lawsuits over their forced early retirement, adding that some have also appealed to international judicial forums for legal remedy.

The cabinet is thinking about a solution regarding the conditions of retirement and may pass a cardinal law on the matter, Justice Minister Tibor Navracsics told Inforádió.
