Court Annuls Ban On Symbols Of Tyranny In Hungary
The Constitutional Court on Tuesday struck down the ban on the use of symbols of the fascist and Communist dictatorships. The Court stated that banning symbols of tyranny may be justified in the interest of defending human dignity and the constitutional order, but the present criminal code is too broad and not sufficiently clear or well defined.

As a result, the Court said, the regulations challenge the requirement of legal security and disproportionately restrict the freedom of expression.

The unconstitutional provision was struck down effective April 30, 2013.

The Court diverted from its own 2000 resolution which found the relevant paragraph constitutional.

In its latest decision the Court referred to the European Court of Human Rights ruling that struck down the ban on symbols of tyranny.
