Strasbourg Court Rules Against Hungary About Disability Pension
The Hungarian state must pay more than 14,000 Euros in compensation and legal fees to a woman in northeast Hungary who was deprived of her disability pension, the European Court of Human Rights said in a non-final ruling. The judges said that Hungary violated her right to property.

Her eligibility for disability pension was withdrawn in 2010 due to a change in calculation methodology. In 2012 she once again applied for disability pension after new regulations came in force that made her eligible based on her condition.

This was refused because she failed to meet the requirement that the disabled person must have at least 1,095 days covered by social security in the five years preceding the submission of his or her request.

The court ruled that her disability pension was a right acquired through having paid social security contributions prior to receiving disabled status, and the state deprived her of this right in violation of the European Convention of Human Rights.
