Retailers Challenge Price Caps on Six Basic Foods in Hungarian Constitutional Court
Multinational food chains operating in Hungary have filed a joint complaint asking the Constitutional Court to establish that the government decrees setting the official prices of six basic foods, introduced in February, are unconstitutional, and to annul them with retroactive effect from their promulgation.

The government decided in January to fix the price of granulated sugar, fine wheat flour, refined sunflower cooking oil, domestic pork leg, chicken breast and chicken back, as well as UHT 2.8% fat milk.

The government ordered that the prices be set at their levels of October 15, 2021.

The related legislation has been challenged by the chains in their constitutional complaint dated August 1.

According to the complaint, the petitioners sold 70-140 products within the official price product groups on October 15, 2021.

When the law was passed, retailers were given a total of two weeks to determine the price level of the products on October 15, 2021.

The petitioners say the legislator did not take into account how much work the transition would mean for companies with the largest commercial turnover within the product groups defined in the regulation.
