Cannabis Controversy: EU Court Claims Hungary Broke Rules
Hungary infringed EU law and the principle of loyal cooperation when it voted against the bloc's common position on the reclassification of cannabis at the UN Commission on Narcotic Drugs, the European Court of Human Rights said.

The case goes back to November 2020, when the Council of the EU adopted a resolution aimed at changing the United Nations' classification of drugs and psychotropic substances. In the vote, Hungary voted against the proposal and made a declaration against the joint position.

The EC then sued Hungary for violating the community's exclusive rights, the council's resolution and the principle of loyal cooperation.

In its ruling, the EU court supported the council's claim and established that Hungary failed to meet its obligations under EU law. They said the EU had the exclusive right to adopt a position for the community, and Hungary violated that right.

They added that the principle of loyal cooperation obliges member states to promote the community's shared tasks and forbear from any activity that could compromise those goals.

Hungary violated that principle, as well as the principle of the unity of representing the EU at international forums, the court said, adding that deviating from the council's strategy could weaken the community's negotiating position against the other parties.
