Hungarian Court Rules Car Loan In Valid, Setting Possible Precedent
A ruling by the municipal court declaring a contract for a car loan invalid on the ground that a trader signed it instead of a bank, could set a precedent, paving the way for several thousand annulments of contracts, Magyar Nemzet daily said.

The contract in question for just below 3 million forints (EUR 9,700) was signed in 2008 with MKB Euroleasing. When the sum was nearly paid off, the client’s car was stolen. At this point, MKB demanded the repayment of the loan, but the client refused to recognise the debt.

The municipal court kept in place a previous ruling that the contract was invalid on the basis that a dealer had signed the contract in place of a bank without authorisation. The client’s lawyer, Krisztina Bihari, told the paper that the court had made a ruling that was likely to set a precedent, and this could affect several thousand other contracts.
