Trócsányi: Hungarian Civil Code Protects Community Symbols Adequately
Responding to a recent proposal by the group leader of the ruling Fidesz party to bolster preventative measures against terrorism by better protecting community and religious symbols, László Trócsányi, the justice minister, said that Hungary’s Civil Code already contains adequate protections.

Group leader Antal Rogán said after a five-party meeting on counterterrorism measures that the fight against terrorism is a national issue and ruling Fidesz is drafting a proposal on protecting community symbols and values. He added that Hungary must develop a common preventive strategy against terrorism.

Trócsányi said citing the relevant passage in the Civil Code: “Any member of a community shall be entitled to enforce his personality rights in the event of any false and malicious statement made in public at large for being part of the Hungarian nation or of a national, ethnic, racial or religious group, which is recognised as an essential part of his personality, manifested in a conduct constituting a serious violation in an attempt to damage that community’s reputation, by bringing action within a thirty-day preclusive period.

All members of the community shall be entitled to invoke all sanctions for violations of personality rights, with the exception of laying claim to the financial advantage achieved.”
