The amendment, initiated by two MPs from the Tisza Party, Márton Melléthei-Barna and István Hantosi, was passed by 135 votes in favour, 50 against and 6 abstentions.

Under the new rule, a person may not be elected prime minister if they have already served as prime minister for a total of at least eight years, including non-consecutive terms.

When calculating this eight-year period, all prime ministerial terms served on or after May 2, 1990 must be taken into account.

The Fundamental Law was also amended to specify that a prime minister’s mandate ends once they have held the office for at least eight years in total.

Another provision establishing the Sovereignty Protection Office was removed from the constitution. That clause had stated that “an independent body, established by a cardinal law, shall operate for the protection of constitutional identity.”

The final provisions of the Fundamental Law were also expanded to state that assets granted by the state to public trust foundations performing public duties will revert to the state.

According to the amendment, assets granted to such foundations by the state as founder, joining party or under any other legal title, as well as the income generated from those assets and any property replacing them, will pass free of charge to the state as universal legal successor when the foundation is dissolved. In addition, property management rights, including those linked to state-owned assets and public duties, will cease.

It was also stipulated that the state exercises the founder’s rights over these foundations and may dissolve them. The rules governing the operation, dissolution and the performance of public and other duties by such foundations will be set out in law.

The amendment will enter into force on the day after its promulgation.
